ゲイリー・ローレンス・フランシオン (Gary Lawrence Francione, 1954- ) は、アメリカ合衆国の法学者。ラトガース大学の法学教授であり、哲学と法学の研究者である[1]。
フランシオンは動物の権利論の草分け的存在であり、動物の権利をアメリカのロースクールで初めて学術的に教義したことでも知られている[2]。 フランシオンは以下の3つの問題に取り組んでいる。
- 財産としての動物の法的地位
- 「動物の権利」と「動物の福祉」の違い
- 知覚と意識のある動物を対象とした動物の権利論
フランシオンは動物権利論における動物利用廃止論のパイオニアであり、従来の搾取への規制法では理論的にも実際的にも動物への待遇向上の効果は聞かれないとし、逆に消費者が心理的に動物を使用しやすくしてしまう逆効果になると指摘する[3]。彼は非人間種＝動物の必要な権利はただ一つしかない、それは人間の所有物やモノにならない権利のことだと議論する[4]。そして廃止論的アプローチの道徳のベースラインはヴィーガニズム、すなわちすべての動物利用の拒絶をすることから始まると述べ、動物の権利は非暴力的な権利活動＝ヴィーガニズムの実践と教育で達成できるはずだという[5]。
1995年からラトガース大学に所属し、ラトガース大学にあるアメリカ唯一の動物の権利法センターのディレクターを務めている。
