中国人排斥法

中国人排斥法（ちゅうごくじんはいせきほう、Chinese Exclusion Act）とは、1882年5月6日にチェスター・A・アーサーアメリカ合衆国大統領が署名した法律。中国人労働者の移住を禁ずる、合衆国史上自由移民に対する最も重い制限の1つであった。1868年米中間で調印された、中国人の自由移民を平等互恵の立場で認めるバーリンゲーム条約[1]に対して、1880年に中国人の移住を停止する旨改正されたことを受け施行。本来は10年間の期限付きとされていたものの、1892年の更新を経て、1902年には恒久的な措置として実施されることとなる。1943年12月17日、マグヌソン法により廃止。

詳細は「中国人排斥法」を参照 カリフォルニアのゴールドラッシュや大陸横断鉄道建設の頃、中国から大量の移民がやって来たためアメリカ国民の反感を買った。南北戦争後の1870年代に景気が悪化すると、中国人の苦力によって給与水準が引き下げられていると主張したカリフォルニア労働党（英語版）のデニス・カーニーとカリフォルニア州のジョン・ビッグラー州知事によって反中感情が政治的に具現され、1868年の天津条約追加条約に続き、1882年5月6日、アメリカ史上初の自由移民の規制である中国人排斥法（排華移民法）としてアメリカ議会を通過した。この法案によりアメリカは移民の停止が可能になり、鉱山などに従事する中国人は技能の有無を問わず入国拒否をうけ、投獄あるいは強制送還された。中国人は鉱山から強制的に退去させられると、サンフランシスコなどのチャイナタウンに住み、底辺の職に就いた。
