著作権トロール

著作権を自身の著作物の保護のために行使するのではなく、訴訟による賠償金獲得を目的として行使すること、あるいはそれを行う者のこと。しばしば侮蔑語として用いられる。
著作権の目的が創作活動の促進や文化の発展とされていることから、その理念に逆行する著作権トロールの行為は、著作権の濫用、悪用だとして非難されることがある。
著作権トロールは、特許における類似の概念である、パテントトロール(特許トロール)の派生語とされる。トロール(troll)の語は本来、北欧神話に登場する妖精に由来するが、「インターネット上で迷惑行為を行う人」という意味で、日本語の「荒らし」に相当するインターネットスラングとしても用いられている。また、トロールの語は、発音と綴りが似たトロール(trawl)漁法とも関連付けられており、自身が保有する著作権の侵害例を探し回る行為が「トローリング」と称されることもある。
著作権トロールは、企業が主体となって行われることもある。例えば、著作権トロールの代表格とされたライトヘイブン(Righthaven)社は、新聞社などから多数の著作権を購入し、それらの著作権で保護された新聞記事を転載したWebサイト運営者などに、次々に訴訟を提起するという「ビジネスモデル」で知られていた。ライトヘイブン社は、勝訴や和解により賠償金を得たこともあったが、経営状況が悪化し、2011年に弁護士費用の納付期限を超過したことにより、連邦保安官局に資産を没収されて事実上倒産した。

コピーライト・トロール(copyright troll)とは、ある種の個人や法人を指して揶揄する語である。著作権トロールとも。コピーライト・トロールは過度に攻撃的に、もしくは情勢を伺いつつ[注釈 1]訴訟を提起しその結果得る金銭的受益のために、自身が保持する著作権の権利行使を行う。しかしながら彼らは商業頒布目的での著作物の作成または著作物の利用の為のライセンス締結を通常行わない。批判者はコピーライト・トロールの行為に反感を持っている。その理由として批判者は、コピーライト・トロールの行為は創作物を生み出すことを萎縮させ、その代わり、著作物の創造を奨励することを意図し定められた著作権法を濫用し、そこに規定される高額な法定損害賠償の不衡平さ(inequity)と意図せざる結果(unintended consequences)[注釈 2]を巧みに利用し金銭を得ていると述べる[1]。
