外国情報監視法（がいこくじょうほうかんしほう、外国諜報活動偵察法、海外情報活動監視法等とも。英語: The Foreign Intelligence Surveillance Act of 1978; FISA、Pub.L.95-511、92 Stat.1783、50 U.S.C. ch. 36）は、1978年に成立した「外国勢力」と「外国勢力のエージェント（協力者）」（すなわち、スパイ活動やテロリズムを行う疑いのあるアメリカの国民とアメリカの永住権を持つ外国人を含み得る）による「外国の情報活動」に対する物理的な捜索および電子機器を使用した監視による情報の収集の手続きについて定めたアメリカ合衆国の法律である[1]。情報収集活動を実施するためには外国情報活動監視裁判所[2]からの令状が必要であるが、その際具体的なテロ容疑者を特定する必要がなく、情報収集の範囲が無制限に拡大されかねないとの懸念や、米国市民のプライバシー保護が不十分との意見がある[3][4][5]。外国情報監視法はアメリカの国外では適用されない。アメリカ同時多発テロ事件以後、外国情報活動監視法は繰り返し改正されてきた。
- ^ 50 USC §1801(b) "“Agent of a foreign power” means--
(2) any person who--
(A) knowingly engages in clandestine intelligence gathering activities for or on behalf of a foreign power, which activities involve or may involve a violation of the criminal statutes of the United States;
(B) pursuant to the direction of an intelligence service or network of a foreign power, knowingly engages in any other clandestine intelligence activities for or on behalf of such foreign power, which activities involve or are about to involve a violation of the criminal statutes of the United States;
(C) knowingly engages in sabotage or international terrorism, or activities that are in preparation therefor, for or on behalf of a foreign power;
(D) knowingly enters the United States under a false or fraudulent identity for or on behalf of a foreign power or, while in the United States, knowingly assumes a false or fraudulent identity for or on behalf of a foreign power; or
(E) knowingly aids or abets any person in the conduct of activities described in subparagraph (A), (B), or (C) or knowingly conspires with any person to engage in activities described in subparagraph (A), (B), or (C)." - ^ 1978年設立、裁判官11人、在ワシントンD.C.
