状況証拠

状況証拠（じょうきょうしょうこ）とは、例えば犯行現場における指紋のように事実認定の結論に結びつくか否かが推論に依拠するような証拠ないしは事実をいう。情況証拠とも表記され、日本の法律学の文献では後者の表記の方が多く用いられているが、日常用語や報道用語としては前者の表記が一般的である。
- ^ Aが第三者からVの財布を受け取ったことは、Aが必ず無実であることを意味しない。「第三者」がAの仲間であればAは共同正犯 Mittäterschaft, autoría conjunta であって、犯人＝Aであることに変わりはないといえる可能性が残る。
- ^ 例えば、被害者や共犯者の供述が「詳細かつ具体的で、迫真的である。」と述べて、その供述の信用性を肯定する裁判例は枚挙にいとまがない。そのような判断過程を体系化する試みの一つに、アルネ・トランケル著、植村秀三訳（1976年）『証言のなかの真実―事実認定の理論―』（金剛出版、東京、1976年6月）がある。
- ^ その危険性を端的に示す一例が、日本で発生した八海事件に関する3次に及ぶ最高裁判所判決である。第2次最高裁判決は、被告人らが犯行への関与を自白する供述調書の記載が「新鮮で生々しく、決して大筋を外れては」いない点を、信用性を肯定する重要な論拠とし、真犯人しか知り得ない新事実を明らかにした部分（秘密の暴露）が見当たらないという第二次控訴審判決の指摘を重視しなかった。
